1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you and Albumly. By creating an account, purchasing a plan, uploading content, or using our services, you agree to these Terms and our Privacy Policy.
Albumly provides a digital album platform for creators at app.albumly.io, photographers and studios at studio.albumly.io, and shareable album experiences on albumly.io and related subdomains. If you use Albumly on behalf of a business, you represent that you have authority to bind that organization.
2. Accounts
You must be at least 16 years old to create an account. You are responsible for maintaining the security of your credentials and for all activity under your account. Provide accurate registration information and keep it up to date. Notify us at contact@albumly.io if you suspect unauthorized access.
We may offer sign-in through third-party providers such as Google. Your use of those providers is also subject to their terms.
3. Your content
You retain ownership of photos, videos, and other materials you upload. You grant Albumly a limited, worldwide license to host, process, display, and deliver that content solely to operate the service — including generating thumbnails, serving public or private digital albums, and enabling downloads you authorize.
You must have the rights to upload and share all content. Obtain appropriate consent from people identifiable in your albums, especially when sharing publicly or with guests. Do not upload unlawful, infringing, or harmful material.
4. Studio accounts
If you are a photographer or studio, you are responsible for your contractual relationship with clients, for the rights to photos you upload, and for sharing settings on each client album. Albumly is not a party to your client contracts.
5. Visitors and PIN-protected albums
Creators and studios may share album links or PINs with visitors. Use shared access only as intended by the album owner. If guest upload is enabled, content you submit is subject to the same limited operational license described in Section 3.
6. Plans, billing, and limits
Free and paid plans, storage limits, album counts, themes, and feature access are described at checkout and in your dashboard. Consumer plans may include a free tier with usage limits. Studio subscriptions are billed monthly or annually based on the plan you select.
Payments are processed by Stripe. We do not store full payment card numbers. Subscriptions renew automatically unless cancelled before renewal. You may cancel through account settings. Price changes will be communicated with reasonable notice.
7. Custom domains
Eligible paid plans may allow connecting custom domains. You are responsible for domain registration and DNS configuration.
8. Acceptable use
You may not misuse the platform, attempt unauthorized access, scrape albums at scale, distribute malware or spam, infringe intellectual property, or use Albumly for unlawful purposes. We may suspend or terminate accounts that violate these Terms or applicable law.
9. Albumly intellectual property
Albumly owns the platform, software, themes, and branding except for your content. These Terms do not grant you rights to use Albumly branding except as allowed in your plan or with our written permission.
10. Disclaimers and liability
The platform is provided “as is” and “as available.” To the maximum extent permitted by law, Albumly disclaims warranties and is not liable for indirect or consequential damages. Our total liability for any claim will not exceed the greater of amounts you paid in the twelve months before the claim or US $100.
You are responsible for maintaining backups of important originals where appropriate.
11. Indemnification
You will indemnify Albumly against claims arising from your content, your use of the platform, or your violation of these Terms or third-party rights.
12. Termination
You may delete your account through account settings. We may suspend or terminate access for violations, non-payment, or operational reasons. Provisions that should survive termination (including disclaimers, liability limits, and indemnification) will survive.
13. Changes and governing law
We may update these Terms from time to time. Material changes will be communicated through the platform or by email. Continued use after changes constitutes acceptance. These Terms are governed by the laws of the State of Delaware, United States, except where mandatory consumer protection laws in your residence apply.
